TERMS OF SERVICE
Welcome to The Forge(“Forge”, “we”, “us”). These Terms of Service (“Terms”) govern your access to and use of entertheforge.co, our mobile and web applications, the digital books, audiobooks, and subscription services we offer (collectively, the “Service”). By creating an account, purchasing a product, or subscribing to a plan, you agree to be bound by these Terms.
If you do not agree, do not use the Service. The Forge is operated from India and these Terms are governed by the laws of India.
1. Eligibility
You must be at least 18 years old to create an account and make purchases on The Forge. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding contract under Indian law.
2. Accounts and Security
When you create an account, you agree to provide accurate, current, and complete information, and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us at forgeverse@entertheforge.co immediately if you suspect unauthorised access.
3. Purchases and Subscriptions
The Forge offers (a) one-time purchases of ebooks, audiobooks, and bundles, and (b) recurring subscriptions billed monthly or annually, and (c) a one-time lifetime membership (“Forge Elite”). Prices are shown inclusive of applicable taxes unless otherwise stated. Payments are processed by Razorpay; we do not store your card or banking details.
- Subscriptions renew automatically at the end of each billing period until cancelled.
- Cancellations stop future renewals but preserve access through the end of the current paid period (industry-standard grace).
- Forge Elite is a one-time payment granting lifetime access; not refundable after content has been accessed (see Refund Policy).
4. Forge Starter Tier — Curated 18-Book Demo
Forge Starter grants access to a curated selection of 18 books (3 per niche) rather than the full catalog. Books outside the Starter selection appear as locked previews and require an upgrade to Forge Pro or Forge Elite to unlock. Pricing reflects this scope and is non-refundable on the basis of the curated access model.
5. Licence and Content Ownership
All books, audiobooks, action plans, and other content on The Forge are licensed to you for personal, non-commercial use during the period of your access (lifetime for Elite, the active subscription period for Starter/Pro, perpetual for direct one-time purchases). You do not acquire ownership of the underlying content.
You agree not to:
- Share, redistribute, sell, sublicense, or publicly display the content;
- Remove, alter, or obscure the watermark or any rights-management indicators embedded in PDFs;
- Reverse-engineer, scrape, or circumvent any access controls;
- Use the content to train, fine-tune, or evaluate machine-learning models without written permission.
6. Watermarking and Anti-Piracy
PDFs delivered to subscribers carry a personalised watermark identifying the viewer and the access date. By accessing subscription content, you consent to this watermarking. Sharing watermarked content publicly is a breach of these Terms and may result in account termination without refund and pursuit of damages under Indian copyright law.
7. Refunds
Refunds are governed by our separate Refund Policy. In short: subscriptions can be cancelled anytime and retain access through the current paid period; we do not pro-rate or refund partial periods. Direct purchases are eligible for a 7-day refund window provided the book has not been substantively accessed.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law;
- Attempt to disrupt, overload, or compromise the Service or any user’s account;
- Use automated means (bots, scrapers) to access or download content;
- Misrepresent your identity or impersonate another user.
9. Suspension and Termination
We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, or any conduct that harms the Service or other users. Upon termination, your access ends; we may retain limited records as required by law.
10. Disclaimers
The Service and content are provided on an “as is” and “as available” basis. The Forge makes no warranties — express or implied — regarding fitness for any particular purpose, merchantability, or that the content will produce any specific result. The content is for informational and educational purposes only and does not constitute professional, medical, financial, legal, or psychological advice.
11. Limitation of Liability
To the maximum extent permitted by law, The Forge’s aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless The Forge and its affiliates from any claims, damages, or expenses arising out of your breach of these Terms, your misuse of content, or your violation of any law or third-party right.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email (to the address on file) at least 7 days before they take effect, except where immediate change is required for legal or security reasons. Continued use after changes constitutes acceptance.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. The parties may first attempt resolution by good-faith negotiation through our support address before initiating formal proceedings.
